Sec. 822.005. ATTACK BY DOG. (a) A person commits an offense if the person is the owner of a dog and the person:
(1) with criminal negligence, as defined by Section 6.03, Penal Code, fails to secure the dog and the dog makes an unprovoked attack on another person that occurs at a location other than the owner's real property or in or on the owner's motor vehicle or boat and that causes serious bodily injury, as defined by Section 1.07, Penal Code, or death to the other person; or
(2) knows the dog is a dangerous dog by learning in a manner described by Section 822.042(g) that the person is the owner of a dangerous dog, and the dangerous dog makes an unprovoked attack on another person that occurs at a location other than a secure enclosure in which the dog is restrained in accordance with Subchapter D and that causes serious bodily injury, as defined by Section 822.001, or death to the other person.
(b) An offense under this section is a felony of the third degree unless the attack causes death, in which event the offense is a felony of the second degree.

  • Laurel Davis my cousin has told me that the parents of this little boy were not together and the rumor in the community is that her colleagues have helped her keep things quiet so that the ex doesn't blame her for negligence. That is just repeating a rumor--no idea how close to the truth it is. The truth will eventually get out, someone in that community knows the dog owners.

  • Laurel Davis no idea how true it is. He has never met her himself. But apparently a co-worker of hers claims that the father has recently been trying to get custody/visitation. I know we are interested in the dog attack not any personal issues--and this had nothing to do with the dog attack. but it COULD be a factor in the coverup. Assuming it is even accurate.

  • Sarah Howard This dear child is dead and people are facing criminal charges. Don't you think the father already knows the truth? The only ones that are being kept out of the loop - the public. Within the last year, the same location, Canyon Lake, Betty Clark died. I think they have a problem there with dogs, not child custody.

  • Laurel Davis no one is going to get custody now, the child is in God's hands. But if the ex gets hold of anything that might point to child endangerment/neglect on her part--that was a contributing factor to the death of his child while under her guardianship, then he could use it to destroy her life and career. So yes--in my mind it is at least a possibility that her colleagues could be keeping something quiet to protect her. To keep things this quiet without even getting to the media for days, shows a level of discipline and loyalty that is rarely seen in those protecting dangerous dogs. So there MAY be something more at stake than a dog's reputation. Just speculation. If there is indeed a criminal trial--it will all come out. I don't know what is going on firsthand--this is something people who claim to know her have told my relative who lives in the area. So take it with a shaker of salt. I do however, see it as a viable possibility that there was thinking along these lines as far as keeping things under wraps.

  • Heidi Schold “Shortly after first responders arrived, Air Life was called. The boy was found with severe lacerations all over his body,” said Jennifer Smith, spokeswoman for the Comal County Sheriff’s Office.

    Smith said the child, identified as Gaege Anthony Ramir
    ez, 7, was airlifted to University Hospital in San Antonio where he later died from his injuries.

    She said the incident is under investigation by sheriff’s detectives and Animal Control officers, so it remains unclear whether any charges will be filed.

    Smith said although the dogs were unspecified breeds, none of them were pit bulls
